I've had a pair for about as long. I've not experienced the technical or build quiality issues you have, but I will agree that the app is trash and I do also wish they had a passive mode. But I also agree that the sound quality and presentation is so staggeringly different, even without EQ, that I forget about the shortcommings.

The build quality is good, but not exceptional. Unfortunately, both my first and my replacement pair share some of the same problems: * Headband creaking * The Focal logos on the ear yokes not being securely attached * Audible creaking noises when switching bitrates in Bluetooth mode
